User data may also be processed for the purposes of analysis in certain circumstances.This may include, for example, using user behaviour and the interests of users identified from user behaviour to create user profiles. Matomo

This website uses Matomo, if you have consented to Matomo being used. Matomo is an open-source web analytics software tool. Web analytics is the collection, collation and analysis of data regarding the behaviour of visitors to websites. A web analytics tool collects e.g. data regarding the website that referred a data subject to our website (known as a referrer), which pages of the website have been accessed and how often and for how long a page on the website was viewed. Any web analytics are primarily used to optimise a website and to analyse the cost/benefit of internet advertising.

The software runs on the data controller's server and the log files, which are sensitive in terms of privacy, are stored exclusively on this server.

The purpose of the Matomo component is to analyse the flows of visitors on our website. The data controller uses the data and information that is obtained e.g. to analyse use of this website in order to compile online reports showing activity on our website.

Matomo creates a cookie on the data subject's computer system. For information about cookies, see above. Creating the cookie allows us to analyse use of our website. Every time one of the pages on this website is accessed, the Matomo component requests the internet browser on the data subject's computer system automatically to send data to our server for the purpose of online analysis. As part of this technical procedure, we obtain knowledge of personal data, such as the IP address of the data subject, which we use e.g. to track the origin of visitors and clicks.

The cookie is used to store personal information, e.g. access time, the address from which the page was accessed and the frequency of visits to our website. Every time you visit our website, this personal data, including the IP address of the internet connection used by the data subject, is sent to our server. We store this personal data. We do not pass on this personal data to third parties.

The legal basis for the data processing is Section 15(3)(3) of the German Telemedia Act (TMG) in conjunction with Article 5(3) of the e-Privacy Directive 2002/58/EC. You give us the necessary consent when you indicate your consent on the cookie notice banner by selecting the "Statistics" opt-in.

Further information and Matomo's applicable privacy policy can be found at the following link:

4. Using the blog features

(1) You can make public comments on our blog, where we publish various posts on relevant topics. If you submit a comment, it is published with the corresponding post and the user name (or pseudonym) that you have provided is displayed. When you post a comment, we internally store your email and IP address; the IP address is automatically deleted once we have accepted your post. This is because we may be liable for the publication of illegal content. We check the comments before publication. We only reserve the right not to publish such content if a post contains illegal content.

5. Job applications

The data controller collects and processes the personal data of applicants for the purpose of managing the application process. Such data is processed on the basis of Section 26(1) sentence 1 of the German Federal Data Protection Act (BDSG) (decision on the establishment of an employment relationship).

If no employment contract is concluded by the controller with the applicant, the application documents are automatically deleted five months after receipt of the application, unless there are other legitimate interests of the controller that outweigh deletion. Such other legitimate interest pursuant to Article 6(1)(f) may be e.g. a duty to provide evidence in proceedings under the German General Equal Treatment Act (AGG).

6. Liability for content

The content of our website has been created with the greatest care. However, we cannot assume any liability for content being accurate, complete or up-to-date. As a service provider, we are responsible for our own content on this website in accordance with general legislation pursuant to Section 7(1) of the German Telemedia Act (TMG). According to Sections 8 to 10 of the German Telemedia Act (TMG), however, we are not obliged as a service provider to monitor transmitted or stored third-party information or to investigate circumstances that indicate illegal activity. Obligations to remove or block use of information in accordance with general laws remain unaffected hereby. However, liability in this regard is only possible from the time of knowledge of a concrete breach of the law. If we become aware of any such breach, we will remove such content immediately.

Our website may contain links to external third-party websites over whose content we have no control. We therefore cannot assume any liability for such external content. The relevant website provider or operator is always responsible for the content of the linked pages. The linked pages were checked for possible breaches of the law when the links were created. No illegal content was identified at the time that the links were created. However, permanent monitoring of the content of linked pages is not reasonable without concrete indications of a breach of the law. If we become aware of any breaches of the law, we will remove such links immediately.

8. Data security

We secure our website and other systems with appropriate technical and organisational measures against loss, destruction, access, modification or distribution of your data by unauthorised persons. However, despite regular checks, full protection against all risks is not possible.
Our website uses the SSL/TLS (Secure Sockets Layer) industry standard for encryption, which ensures the confidentiality of your personal information over the internet. The padlock or lock icon on your browser indicates whether encryption is being used for data transfer. Please note that sending data over the internet (e.g. communicating by email) is not completely secure. It is not technically possible to protect your data against access by third parties in all circumstances.

9. Disclosure of data

Your personal data is only disclosed to third parties:

  • if you have given your express consent to disclosure pursuant to Article 6(1)(a) GDPR;
  • if disclosure is necessary for the performance of contractual obligations pursuant to Article 6(1)(b) GDPR;
  • if we are legally required to disclose the data within the meaning of Article 6(1)(c) GDPR;– if disclosure of the data is in the public interest within the meaning of Article 6(1)(e) GDPR; or
  • if disclosure of the data is necessary in accordance with Article 6(1)(f) GDPR to protect our legitimate interests or the legitimate interests of a third party, except where such interests are overridden by your interests in the protection of your data.

10. Categories of recipients

Processors

We use IT service providers who work exclusively in accordance with our instructions (processing on behalf of the controller) to provide the service offered, e.g. hosting this website or operating our IT. We have carefully selected these service providers, who are required to follow our instructions and are regularly checked.

Third-party recipients

In order to process your queries satisfactorily, we may need to disclose your personal data to third-party recipients. Third-party recipients may be our suppliers, transport and logistics partners or our trading partners. If necessary, we will forward your data for processing within our group of companies. The group of companies includes:

  • Kuhn Special Steel, Otto-Hahn-Straße 12-14, 42477 Radevormwald, Germany

11. Duration of storage of personal data

We store your data for as long as it is required for the applicable purposes on which processing is based. Otherwise, we only store data if we are legally obliged to do so, e.g. because of statutory retention obligations.

12. Detailed information regarding the right to object

You have the right to object to the processing of personal data concerning you, based on Article 6(1)(e) (data processing in the public interest) or (f) (data processing for the protection of legitimate interests based on a balancing of interests) at any time in accordance with Article 21 GDPR. In the event of objection, the personal data is no longer processed unless compelling legitimate grounds for the processing are demonstrated which override the interests, rights and freedoms of the data subject or for the establishment, exercise or defence of legal claims. Please send your objection using the controller's contact details under section 1.

If you have given us your consent to the processing of personal data, you can withdraw your consent at any time. Of course, this also applies to declarations of consent you made to us prior to 25 May 2018 (before GDPR came into effect). Any withdrawal of consent can only apply to the future. Withdrawal does not affect the lawfulness of processing carried out before withdrawal. Please send your withdrawal of consent using the controller's contact details under section 1.
